Acceptance
These Terms of Use apply to https://www.donmorrowcpa.com (the "Site"), operated by Donald E. Morrow, CPA & Associates ("we," "us," or "our"). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
The information here is general
The Site describes our services and shares general information about taxes. Tax rules change often, and how they apply depends on your particular facts.
Nothing on this Site is tax, legal, accounting, or financial advice for your situation. Do not act on anything here without talking to a qualified professional about your own circumstances. We make no promise about any particular tax result, refund, or savings.
Using the Site does not make you a client
Reading the Site, filling out a form, or sending us an email does not create a professional relationship between us. We become your tax professional only when we both agree in writing to the work and the fee.
Until that happens, please do not send us confidential information. Anything you send before an engagement is in place may not be treated as confidential.
Fees and pricing shown on the Site
Any prices shown are starting prices for typical work, and they are subject to change. The fee for your work is the one in your written engagement, not the one on the Site.
Acceptable use
You may use the Site for your own lawful, personal, or business purposes. You agree not to:
Use the Site in a way that breaks any law
Try to gain access to any part of the Site, server, or account you are not authorized to use
Interfere with how the Site works, or introduce any virus or harmful code
Copy, scrape, or collect content from the Site in bulk, including by automated means
Use the Site's content to build a competing service, or to train software, without our permission
Impersonate anyone, or misrepresent who you are
Our content
The content on the Site, including text, images, logos, and layout, belongs to us or to the people we license it from, and is protected by copyright and trademark law. You may view and print pages for your own use. You may not republish, sell, or use our content commercially without our written permission.
Links and third-party services
The Site links to websites and tools we do not control, including government websites and our secure client portal. We provide those links for convenience. We do not endorse and are not responsible for their content, their accuracy, or their practices. Your use of a third-party service is governed by that service's own terms.
Client portal
If you are given access to our secure document portal, you agree to keep your login details confidential, to use the portal only for your own matters, and to tell us right away if you believe someone else has used your account. The portal provider's terms also apply.
Communications
If you give us your email address or phone number, you agree we may contact you about your inquiry or your work with us. You can ask us to stop sending non-essential messages at any time. Standard message and data rates may apply to text messages.
No warranties
The Site is provided "as is" and "as available." We do our best to keep it accurate and running, but we do not warrant that it will be uninterrupted, error free, or free of harmful components, or that the information on it is current or complete. To the fullest extent the law allows, we disclaim all warranties, express or implied.
Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, including lost profits or lost data, even if we were told such damages were possible.
Nothing in these terms limits any responsibility we owe you under a signed engagement, or any responsibility that cannot be limited by law.
Indemnification
You agree to cover our reasonable costs, including attorney fees, if a claim arises from your misuse of the Site or your breach of these terms.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts of Colorado, and you agree to the jurisdiction of those courts.
Changes
We may update these terms. When we do, we will change the "Last updated" date at the top. Continuing to use the Site after a change means you accept the updated terms.
If part of these terms does not hold up
If any part of these terms is found unenforceable, the rest stays in effect.
